A Palm Beach County judge is the fourth in Florida in less than three weeks to rule the same-sex marriage ban is unconstitutional.
Specifically Judge Diana Lewis says a married, gay man can be his dead husband's personal representative in Florida.
Equality Florida Executive Director Nadine Smith says with more than 30 similar rulings in a row nationwide it's time to overturn the ban once and for all.
She feels "we shouldn't have to go to court one at a time to deal with the absurd legal entanglements and complications that occur because our families aren't recognized, our marriages aren't recognized."
Judges in Monroe, Miami-Dade and Broward Counties have all shot down the ban.
A verdict is expected soon in a second Palm Beach case where a gay, married man is suing Florida Atlantic University for in-state tuition.
The American Civil Liberties Union is also awaiting a Tallahassee federal court's decision asking for gay marriages in other states to be recognized.
