Polk County Shooting May Fall Under Stand Your Ground Law

LAKE ALFRED -- A shooting death in Polk County over the weekend could be covered by the stand your ground law.

Polk Sheriff Grady Judd says 24-year-old shooting victim Jean Carlos "Felix" Colon was following 19-year-old Emanuel Herrera and Herrera's sister through a Lake Alfred tralier park. There was a confrontation involving Herrera Colon and Colon's brother Joseph, when Herrera shot him.

Judd says Herrera believed Colon was armed. Turns out, he wasn't. But the sheriff says that belief may be sufficient under the law.

"If you scare people, if they believe you have a gun, if they believe you have a knife, they're likely to shoot you

The case has been turned over to the State Attorney.
